Are there circumstances under which my application is not examined?

Yes, there are two circumstances under which your application is not examined

a) Incompetency of the Grand Duchy of Luxembourg

The MAEE may declare itself incompetent to examine your application for international protection if another European country is responsible for your application. In that case, you will be transferred to the country responsible for your application.

b) Inadmissibility of an application

Your application will be declared inadmissible if:

  • You are a citizen of the European Union
  • You have been granted international protection by another EU member state
  • You benefit from international protection or another form of sufficient protection in a third country and your readmission in that country is guaranteed
  • You could have moved to a save third country where your life and liberty are not threatened on account of race, religion, nationality, membership of a particular social group or political opinions and where there is no risk of serious harm.
  • Your application is not your first application and you do not present any new element which would allow to determine whether you fulfil the conditions for international protection in that new application
  • You personally introduced an application after having consented that your case be treated in the context of an application introduced in your name.
